Intellectual Property
The marks, work and know-how the business owns, and the paperwork that proves it.
The marks, work and know-how a business owns, and the paperwork that proves it. That starts with searching and filing a trade mark before the name is on a signboard, and with keeping the registrations that follow alive through their renewals and use requirements.
It also covers the part companies discover late: that work produced by a contractor belongs to the contractor unless the agreement says otherwise, and that confidential information is only confidential while it is treated that way.
What’s included
- Trade mark searches, filings and prosecution
- Replies to examination reports and opposition
- Renewals, assignments and the register kept current
- Copyright ownership in work produced by staff and contractors
- Assignment and licence terms in commercial agreements
- Confidentiality and trade secret protection
How it runs
Establish what you own
We take stock of the marks in use, the work produced for you, and what the agreements behind them actually assign.
File and fix
Applications for what is unprotected, and corrected assignment terms where ownership was never transferred properly.
Keep the register alive
Renewals, deadlines and use requirements tracked, so a registration is not lost to a date nobody was watching.
FAQs
When should we file a trade mark?
Before the name is in public use, if the choice is open. Filing is dated from the application, so an earlier date is a better position, and a search before launch is far cheaper than a rebrand after an objection.
Does our contractor own the work we paid for?
Often yes, unless the agreement assigns it in writing. Payment alone does not transfer copyright in India. This is one of the most common gaps we find during onboarding.
