You will carry recovery files from first search to close: establishing what an institution is holding, proving a claimant's entitlement to it, and dealing with registrars, companies, funds, insurers and debtors in writing. Files are held whole rather than in stages, and you will deal with the client directly on the ones you hold.
Scope of work
- Establish what exists on a matter, from public registers, company and registrar records, and whatever documents the client still holds
- Prepare and follow claims to their conclusion, including Form IEPF-5, duplicate securities and transmission requests to registrars, and claims to insurers and fund houses
- Advise on the succession route a matter actually runs on: nomination, will and probate, succession certificate or legal heirship, and build the document set to fit the value involved
- Draft affidavits, indemnity bonds, no objection declarations and representations against refusals, in the formats institutions accept
- Triage business debtor ledgers by documentation, limitation and debtor status, and prepare demand notices, statutory notices and references
- Draft escalations through investor, insurance, banking and fund grievance channels, and to the relevant ombudsman
- Prepare matters that require an appearance, and appear where you are instructed to and qualified to
- Keep the written record on every file so a matter can be escalated on evidence rather than recollection
Requirements
- LL.B. from a recognised university, with one to four years in corporate, commercial, banking or recovery practice
- Enrolment with a State Bar Council, or eligibility for enrolment and the intention to enrol
- Working knowledge of the Companies Act, 2013 and the IEPF rules, the Indian Succession Act, 1925, the Limitation Act, 1963, the Negotiable Instruments Act, 1881 and the Insolvency and Bankruptcy Code, 2016
- Demonstrated drafting ability, particularly on affidavits, indemnities and written representations
- Patience with institutional process, and the discipline to chase a matter in writing over many months
- Ability to explain a slow and uncertain process to a client honestly, including when the answer is that nothing is worth pursuing
- Judgement to identify conflicts, entitlement disputes and limitation issues and escalate them
